1. Agreement to Terms

By accessing or using Tacholife ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Tacholife is a digital defect management application that helps you identify, record, and report asset defects for vehicles, trailers, machinery, and other equipment. The Service includes:

  • Mobile and web applications for defect recording
  • Customizable defect checklists
  • Asset management and tracking
  • Reporting and analytics features
  • Technical support during business hours

3. User Accounts

Account Creation: To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account and password.

Account Responsibility: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Eligibility: You must be at least 18 years old and have the legal capacity to enter into these Terms.

4. Subscription and Payment

Free Trial: New users receive a free trial period covering the first billing cycle to evaluate the Service.

Subscription Fee: After the trial period, the Service costs £1.00 per Active Asset per month. An Active Asset is any asset registered in the system that hasn't been deleted from the "Assets" section in the application.

Billing: Subscription fees are charged monthly in advance and must currently be paid via bank transfer.

Payment Methods: We currently accept payments by bank transfer only.

Late Payment: If payment is delayed more than 14 days, your account may be suspended.

Refunds: Subscription fees are non-refundable except as required by law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Transmit or store any unlawful, harmful, or offensive content
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Reverse engineer, decompile, or disassemble the software
  • Use the Service to compete with us or create a similar product
  • Share your account credentials with others
  • Use the Service beyond the scope of your subscription

6. Intellectual Property

Our IP: The Service and all related technology, software, and content are owned by Tacholife Limited. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

Your Content: You retain ownership of any data, information, or content you submit to the Service. You grant us a license to use this content solely to provide the Service to you.

Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

7. Data Protection and Privacy

Data Processing: We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR.

Data Security: We implement appropriate technical and organizational measures to protect your data against unauthorized access, loss, or damage.

Data Retention: We retain your data for 15 months after processing, or until you request deletion, whichever comes first.

8. Service Availability

Uptime: We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

Updates: We may update the Service from time to time. We'll notify you of significant changes that affect functionality.

9. Limitation of Liability

Service Disclaimer: The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Liability Limits: To the maximum extent permitted by law, our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Excluded Damages: We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business interruption.

Exceptions: Nothing in these Terms excludes our liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

10. Termination

Termination by You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Termination by Us: We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for other reasonable business reasons. We'll provide reasonable notice when possible.

Effect of Termination: Upon termination, your right to use the Service stops immediately. We may delete your data after a reasonable period, but will provide you with an opportunity to export your data.

11. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we'll notify you by email or through the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

12. General Provisions

Governing Law: These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
